Because lingerie and intimate apparel may involve personal fit, hygiene, and sanitary considerations, customers should carefully review product descriptions and applicable return restrictions before purchasing. We do not guarantee that a particular garment will fit in the manner expected by a customer.

Orders, Pricing, and Payment

All orders submitted through the Website are subject to acceptance by Blush Boudoir Boutique. Submission of an order does not constitute acceptance of the order or create an obligation for us to sell or ship the requested product.

We reserve the right to refuse, limit, modify, or cancel any order for any lawful reason, including product availability, pricing errors, suspected fraud, inaccurate billing or shipping information, suspected unauthorized resale, violation of these Terms, purchasing activity that appears commercially unreasonable, or other circumstances that present a legal, security, inventory, or business concern.

All prices displayed on the Website are stated in U.S. Dollars unless otherwise indicated and may be changed at any time without prior notice. We make reasonable efforts to maintain accurate pricing; however, technical errors, typographical errors, system malfunctions, inventory errors, or other circumstances may result in an incorrect price being displayed.

If a product is listed at an incorrect price, we reserve the right to correct the price and cancel or refuse orders submitted using the incorrect price, including orders for which payment has already been authorized. If an order is canceled after payment has been processed, the applicable purchase price paid for the canceled order will be refunded.

By submitting an order, you represent and warrant that you are authorized to use the payment method provided and authorize Blush Boudoir Boutique and its third-party payment processors to charge the applicable purchase price, sales or use taxes, shipping charges, and other disclosed fees.

If payment cannot be successfully processed, we may suspend, delay, or cancel the order until payment is successfully completed.

Shipping and Delivery

Delivery times may be affected by inventory availability, carrier delays, weather, holidays, customs processing, incorrect shipping information, service interruptions, or other circumstances outside our reasonable control.

Customers are responsible for providing complete and accurate shipping information. We are not responsible for shipments delayed, returned, misdelivered, or otherwise affected because of inaccurate or incomplete information supplied by the customer.

Additional shipping charges associated with returned packages, address corrections, reshipments, refused deliveries, or other customer-caused delivery issues may be charged to the customer to the extent permitted by law.

Risk of loss and title to products generally pass to the customer upon delivery of the products to the shipping carrier, except where otherwise required by applicable law.

Returns, Exchanges, and Refunds

Returns, exchanges, store credits, and refunds are governed by the Blush Boudoir Boutique Return Policy, which is incorporated into these Terms by reference.

Because Blush Boudoir Boutique sells lingerie, intimate apparel, and products that may come into close contact with the body, certain products may be subject to special return, exchange, hygiene, sanitary, or final-sale restrictions. To the maximum extent permitted by applicable law, we may refuse returns or exchanges for products that have been worn, used, washed, altered, damaged, soiled, stained, laundered, exposed to fragrances or other substances, or otherwise returned in a condition that makes the product unsuitable for resale.

Products that are designated as final sale, non-returnable, intimate-use products, or otherwise excluded under the applicable Return Policy may not be eligible for return, exchange, store credit, or refund except where required by applicable law.

Where applicable, products must be returned with original tags, packaging, hygiene liners, protective materials, and other components required by the Return Policy.

Refunds approved by Blush Boudoir Boutique will generally be issued to the original payment method unless otherwise required by law or expressly agreed by us. Original shipping charges, expedited shipping charges, return shipping charges, and other service-related fees may be non-refundable unless required by applicable law.

Nothing in these Terms limits any non-waivable consumer rights provided by applicable law.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BLUSH BOUDOIR BOUTIQUE'S TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE WEBSITE, PRODUCTS, SERVICES, OR THESE TERMS SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU ACTUALLY PAID TO BLUSH BOUDOIR BOUTIQUE FOR THE PRODUCT OR SERVICE GIVING RISE TO THE CLAIM DURING THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS (US $100.00).

Some jurisdictions do not permit certain limitations or exclusions of liability. Accordingly, some of the foregoing limitations may not apply to you. In such jurisdictions, liability will be limited to the maximum extent permitted by applicable law.

Indemnification

Class Action Waiver

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, YOU AND BLUSH BOUDOIR BOUTIQUE AGREE THAT ANY CLAIM OR DISPUTE ARISING OUT OF OR RELATING TO THESE TERMS, THE WEBSITE, OR ANY PURCHASE SHALL BE BROUGHT ONLY IN THE RESPECTIVE PARTY'S INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, CONSOLIDATED, REPRESENTATIVE, OR PRIVATE ATTORNEY GENERAL ACTION.

This provision applies only to the extent that such a waiver is enforceable under applicable law.

Severability

If any provision of these Terms is determined to be unlawful, invalid, or unenforceable, that provision shall be enforced to the maximum extent permitted by applicable law and the remaining provisions shall remain in full force and effect.

No Waiver

Our failure to enforce any provision of these Terms shall not constitute a waiver of our right to enforce that provision or any other provision in the future.

Changes to These Terms

Blush Boudoir Boutique reserves the right to modify or update these Terms from time to time. Updated Terms will become effective upon posting to the Website unless a later effective date is expressly stated.

Your continued access to or use of the Website following the posting of revised Terms constitutes your acknowledgment and acceptance of the revised Terms to the extent permitted by applicable law.
