Agreement to Receive Text Messages
By providing your mobile telephone number and affirmatively opting into any SMS or MMS messaging program offered by Blush Boudoir Boutique ("Blush Boudoir Boutique," "Company," "we," "our," or "us"), you expressly consent to receive recurring automated and non-automated text messages at the mobile telephone number you provided.

Message Frequency

SMS services may not be available on every wireless carrier, mobile device, or geographic location.
Updating Your Mobile Number

You represent that you will not enroll a telephone number belonging to another person without that person's authorization.

BLUSH BOUDOIR BOUTIQUE DOES NOT GUARANTEE THAT TEXT MESSAGES WILL BE DELIVERED WITHOUT INTERRUPTION, DELAY, ERROR, DUPLICATION, OR OTHER FAILURE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, BLUSH BOUDOIR BOUTIQUE DISCLAIMS ALL WARRANTIES RELATING TO THE MESSAGING PROGRAM, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, BLUSH BOUDOIR BOUTIQUE, ITS OWNERS, AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, AGENTS, VENDORS, MESSAGING PROVIDERS, AND SERVICE PROVIDERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATING TO YOUR PARTICIPATION IN THE MESSAGING PROGRAM, INCLUDING DAMAGES RESULTING FROM DELAYED, FAILED, DUPLICATED, MISDIRECTED, OR UNDELIVERED MESSAGES.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, BLUSH BOUDOIR BOUTIQUE'S TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE MESSAGING PROGRAM SHALL NOT EXCEED THE GREATER OF (A) ONE HUNDRED U.S. DOLLARS (US $100.00), OR (B) THE AMOUNT YOU PAID DIRECTLY TO BLUSH BOUDOIR BOUTIQUE FOR THE APPLICABLE MESSAGING SERVICE DURING THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.
Some jurisdictions do not permit certain limitations of liability. Accordingly, some of the foregoing limitations may not apply to you, and liability will be limited to the maximum extent permitted by applicable law.
Governing Law
These Mobile Messaging Terms shall be governed by and construed in accordance with the laws of the State of Wyoming, without regard to conflict of law principles, except to the extent that applicable federal law or mandatory consumer-protection law requires otherwise.
Any dispute concerning these Mobile Messaging Terms or the messaging program shall be subject to the dispute-resolution and venue provisions contained in the Blush Boudoir Boutique Terms of Service to the extent applicable and enforceable.
Changes to These Terms
Blush Boudoir Boutique may revise these Mobile Messaging Terms from time to time to reflect changes to our messaging program, technology, business operations, legal requirements, carrier requirements, or compliance practices.
Updated versions become effective upon posting to the Website unless a later effective date is expressly stated.
Your continued participation in the messaging program after revised Terms become effective constitutes your acknowledgment and acceptance of the updated Terms to the extent permitted by applicable law.
